The physician, on the other hand, would be liable for the unlicensed person's actions, and the physician would have to (1) be qualified to inject Botox; (2) ensure that the unlicensed person is minimally competent to inject Botox; and (3) make it clear to the patient and others that the delegate is an unlicensed person performing the act under the physician's supervision.
