Wisconsin

A physician may delegate patient services that are directed, monitored, and inspected by the physician, who must have the authority to guide, determine, and oversee the implementation of the patient services provided in Wisconsin to someone other than a PA or anesthesiologist assistant. Thus, physicians may prescribe Botox, and they may delegate Botox injections to everyone who meets this requirement, including nurse practitioners and registered nurses.

PAs are allowed to do something that does not go beyond their qualifications, training, or the area of practice of their supervising physician, so they can administer Botox if certain conditions are met.

Since NPs can prescribe and administer prescription drugs, they are likely to be able to administer Botox themselves rather than by delegation.

A physician who has the power to guide, decide, and oversee the implementation of the client services provided in licensed establishments may delegate services constituting the practice of medicine to persons who hold a license issued by the Cosmetology Examining Board (CEB), including estheticians and cosmetologists.CEB licensees are also restricted to the delegable medical procedures specified in the relevant regulation, which include laser hair removal, certain microdermabrasion procedures, and certain chemical exfoliation procedures. Botox isn't on the list of delegable medical treatments, but estheticians and cosmetologists wouldn't be able to use it even though they were supervised.

A physician may delegate the administration of Botox to an unlicensed individual under Wisconsin's general delegation rule. The physician, on the other hand, would be liable for the unlicensed person's actions, and the physician would have to (1) be qualified to inject Botox; (2) ensure that the unlicensed person is minimally competent to inject Botox; and (3) make it clear to the patient and others that the delegate is an unlicensed person performing the act under the physician's supervision.
