Botox will currently be performed by doctors, PAs, and NPs in New Jersey. A PA is allowed to offer injections and prescribe drugs as long as they are done with the proper level of supervision and are within the PA's and supervising physician's skill set. NPs are permitted to administer injections if they are approved to do so by a collaborative protocol established in conjunction with a physician and the NP is supervised appropriately.


However, the BME has introduced an update to the delegation regulations that reflects the BME's views on proper delegation. Although they are not yet formally accepted, the BME does provide licensees with informal guidelines based on them. A physician can direct an RN, NP, or PA to inject fillers or neuromuscular blockers, such as Botox, collagen, and other fillers, under the proposed regulation. FDA approval is required for any fillers or neuromuscular blockers.If a physician instructs an RN, NP, or PA to perform either of these procedures, the physician must first take a medical history, perform a physical examination, and establish a care plan for the patient for which the operation will be performed, which includes the approximate number of treatments for the patient (NOTE: the physician may direct the RN, NP, or PA to take the medical history and perform the physical examination, as long as the physician reviews that data and personally examines the area that will be treated prior to the initiation of treatment);(2)maintain the patient's medical history and care plan as part of his or her medical records; (3) ensure that the RN, NP, or PA knows that they must alert the physician if the patient has symptoms or adverse events; (4) monitor the patient's progress at the conclusion of the treatments; (5) provide an antidote for reactions to fillers on hand; and (6) be on site when an RN or NP is on call.
